MD Predatory Lending Law

As reported in this article, the Maryland Federal Court recently determined that national banks are exempt from particular Maryland predatory lending laws. Specifically, the case deals with the applicability of Commercial Law Article 12-105(b)(4) to national banks. You may also want to see this Attorney General Opinion.

UCC AND MD UCC

Remember that when you're doing UCC work, when MD implemented the UCC in the Commercial Law Article of the MD Code, they did so using the same numbering system used in the UCC. As a result, if you know the section in the UCC, you can use that same section number to find the place in the Commercial Law Article, and the other way around. As an example, Section 3-207 entitled "Reaquisition" of the Commercial Law Article is the same section, 3-207 in the UCC itself.

Government Contracts

Remember the Halliburton issue? In that case, questions were raised when the award of US government contracts appeared to go to particular contractors. If you're interested in this issue, take a look at State Finance and Procurement article of the MD Code at 13-107. The comparable federal statute is 41 USC 253.

Maryland Lemon Law

Autopedia publishes a site on lemon law in all 50 states (in bright lemon color, no less), including a number of pages on Maryland lemon law. One page includes the Maryland lemon law statute itself, while another provides a guide for consumers. The Attorney General's office also publishes "Your Rights Under Maryland's Lemon Law," and the MVA publishes a resource entitled "Maryland's Lemon Law."
