MD Predatory Lending Law

As reported in this article, the Maryland Federal Court recently determined that national banks are exempt from particular Maryland predatory lending laws. Specifically, the case deals with the applicability of Commercial Law Article 12-105(b)(4) to national banks. You may also want to see this Attorney General Opinion.

In 2008 I refinanced my condo in Columbia, MD and was surprised that my loan application was accepted as I am not exactly a financial genius which is to say that anyone looking at my financial history would know that I was/am a risk. Without asking for advice I signed papers and agreed to an interest only loan which will change over to a regular loan next year. The loan was for $1144,000 of which I have paid down about $4,000.00. I believe I am a victim of a predatory loan and wondering if anyone has some advice as to whether I might have a case to pursue.

Make that a loan for $144,000.00 not $1144.00. Sorry.
